These terms and conditions stipulate the matters that you must comply with when using the "F-POINT Official App" service provided by FTG Company, Inc.

Please read these terms and conditions in their entirety and agree to them before using the "F-POINT Official App" website, application software, etc.

Article 1 (Definition of Terms)

The terms used in these terms and conditions are defined as follows:

(1) "Our Company" refers to FTG Company, Ltd.

(2) "This App" refers to the "F-POINT Official App" provided by our company.

(3) "This Service" refers to the service provided through the official F-POINT app.

(4) “User” refers to a person who agrees to these Terms and Conditions and has entered personal information and other necessary information in the manner specified by the Company in order to use the F-POINT official app.

(5) "Membership Rank Program" refers to a system in which users earn points and receive various rank benefits according to the rank determined by the points they have.

Article 2 (Overview of the F-POINT Official App Service)

The contents of the Service that we provide to users are as follows. Furthermore, we reserve the right to freely modify the Service and add new services at our sole discretion, and users must agree to this before using the Service. Furthermore, users must not use the Service for business purposes.

(1) To enable users to view, use, and save point services, messages, coupons, and reservation services provided by our company.

(2) Services related to the preceding paragraph of this Article

Article 3 (User Registration)

1. Anyone who wishes to use this service must agree to these terms and conditions and apply for user registration in the manner specified by our company. Once user registration is complete, a service usage contract (hereinafter referred to as the "User Agreement") will be established between the customer and our company, and the customer will be able to use this service in accordance with these terms and conditions. In order to register, a smartphone with NFC tag reading capabilities and connected to the Internet is required.

2. If any of the following circumstances apply to the person in the preceding paragraph, the Company may refuse or delete the user registration, and shall not be obligated to disclose the reasons therefor.

(1) If any part or whole of the registration information provided to the Company is false or incorrect

(2) If the Company determines that a person is an antisocial force, or is cooperating with or involved in the maintenance, operation or management of an antisocial force through funding or other means

(3) If the Company determines that the individual is a person who has previously violated a contract with the Company or a related party to such a contract

(4) Any other case in which the Company determines that use of the Service is inappropriate.

Article 4 (Acquisition of User Information)

1. In order to provide the Service and to improve the convenience of all users of the Application, the Company may obtain the device name, OS, and the Application's identification ID (hereinafter collectively referred to as "User Information." Please note that User Information does not include information such as name, email address, or credit card information).

2. If you are logged in to the same membership ID from multiple devices, we may collect device-specific information about the device you are using in order to ensure that the push notification function of the app works properly. This information will not be used for any other purpose.

3. In principle, we will not disclose user information to third parties, but we may provide user information to third parties in the following cases. However, we will only provide the minimum amount of user information necessary, and we will take measures to prevent user information from being leaked, lost, or tampered with.

(1) When outsourcing operations related to the provision, marketing, development of new services, and improvement of the Service to a third party

(2) When disclosure is requested by a public institution for a legitimate reason.

(3) Other cases where the user has given their voluntary consent.

4. The Company will appropriately handle User information and personal information acquired through the App in accordance with the "Personal Information Protection Policy."

Article 5 (Acquisition and Use of Points)

1. To earn and use points, you need to scan the "CHECK IN" NFC tag displayed on tables etc. in the store.

2. In the preceding paragraph, it is the User's responsibility to scan the tag every time they visit the store. If the User does not scan or is unable to scan the NFC tag, points will not be awarded or used, and the User will not be eligible for compensation.

3. In the event of an infrastructure problem with respect to the use and acquisition of points (such as an inability to connect to the Internet or mobile data, or the F-Point server being down), users may be unable to scan NFC tags, we may be unable to award points, or users may be unable to use points for payment. In such cases, points cannot be claimed or used, and no compensation will be provided.

Article 6 (Member Rank Program)

1. The types of ranks and the contents of the benefits will be determined separately by our company.

2. Membership ranks are updated monthly based on policies published by the Company, and a User's membership rank may go up or down. However, a User's membership rank as of April 30, 2024 will not be updated until November 1, 2024.

3. Membership rank decisions are at the discretion of the Company, are final and cannot be challenged.

Article 7 (Matters to be complied with, etc.)

Users shall comply with or agree to the matters set out in each of the following items.

(1) When using our point service, users must follow the rules established by our company and agree in advance that points will be added or subtracted in accordance with those rules.

(2) The rules of the point service described in the preceding paragraph will be notified to the User by sending an email to the email address registered by the User, posting it on the website or app of this Site, or by any other method that the Company deems appropriate.

(3) When using the Service, Users shall comply with these Terms and Conditions and use the Service at their own expense and responsibility.

(4) Users shall not transfer, change the name of, sell, etc. their status under the service contract or their rights or obligations as a member under these Terms and Conditions to a third party.

(5) Users shall properly manage the authentication information for this service at their own responsibility.

(6) Users agree in advance to receive communications, advertisements, and other information from our company via email and app push notifications.

(7) We are not liable for any problems related to the downloading, installation or operation of this App (including problems related to this App and this Service), any effects on your mobile phone, or any other disadvantages arising from or related to the downloading and installation of this App.

(8) The Company may, at its own discretion, upgrade the App. Depending on the content of the upgrade, the App may become unusable. The User agrees to this, and the Company shall not be held liable for any damages incurred by the User or Member as a result. The Company shall not be obligated to upgrade the App.

Article 8 (Prohibitions)

Users shall not engage in any of the following acts in relation to this service:

(1) Any act that violates laws and regulations or is related to a criminal offense

(2) Fraudulent or threatening conduct against the Company, other users, or third parties

(3) Any act that infringes or may infringe the copyright or other intellectual property rights of the Company, other users, or third parties.

(4) Any act that infringes or may infringe on the property rights, privacy rights, portrait rights, or other personal rights or interests of the Company, other users, or third parties.

(5) Any act that libels or slanders the Company, other users, or third parties, or otherwise infringes upon their reputation, or that may infringe upon such reputation.

(6) Any act that causes disadvantage, damage, or offense to our company, other users, or third parties.

(7) Using information obtained through the use of this service for purposes other than those of the service.

(8) Unlawfully collecting, storing, or using information about other users.

(9) Improperly collecting, accumulating, or using point services or coupons provided within the Service.

(10) Unauthorized creation or use of authentication information for the Service, or allowing a third party to use it, or lending or transferring it.

(11) Posting or transmitting harmful computer programs, etc.

(12) Any act that may disrupt the operation of this Service.

(13) Using the authentication information of other users.

(14) Any act that violates public order and morals

(15) Any act that directly or indirectly encourages any of the acts listed above.

(16) Any other act that the Company deems inappropriate.

Article 9 (Notifications, Contact, etc.)

1. The Company will notify and contact the User of any matters necessary as part of the operation, advertisement, or functionality of the Service by sending an email to the email address registered by the User, posting on the Site's website or app, or by any other method the Company deems appropriate.

2. In the case where the Company notifies or contacts the user by sending an e-mail, it will take effect at the time when the Company sends the e-mail. In the case where the Company notifies or contacts the user by posting on the site, it will take effect at the time when the notice, contact, etc. is posted.

Article 10 (Disclaimer)

1. In the event of force majeure such as natural disasters or communication line failures, or when the Company deems it necessary, the provision of the Service to Users may be temporarily suspended without prior notice to Users.

2. We shall not be liable for the completeness, accuracy, reliability, or validity of the content of this service or the information that users obtain through this service.

3. We shall not be liable for any damages suffered by the user due to this service (including the interruption or discontinuance of this service), except in cases where this is due to willful misconduct or gross negligence on the part of us.

Article 11 (Copyright, Contact Information, and Other Matters)

1. In the event that copyright arises in information that a user transmits or provides to this service, the user shall grant the Company a royalty-free and non-exclusive right to use such information (such as copying, screening, public transmission, exhibition, distribution, translation, modification, and granting permission to third parties to use such information). Furthermore, the user shall not exercise any moral rights of the author with respect to the provided data.

2. All intellectual property rights relating to this App and this Service belong to our company.

3. These Terms and Conditions shall be governed by the laws of Japan.

4. If a dispute arises between a user and our company in connection with the Service provided by our company, the Tokyo Summary Court or the Tokyo District Court shall be the court of first instance with exclusive jurisdiction, depending on the amount of the claim.

Article 12 (Changes to these Terms)

These Terms may be revised in accordance with Article 548-4 of the Civil Code when changes to laws and regulations, instructions from supervisory authorities, or other necessary circumstances arise. In accordance with the provisions of the same article, the Company will notify you of the revision, the content of the revised provisions, and the effective date of the revised provisions in the manner specified in Article 9, Paragraph 1 of these Terms. Article 13 (Withdrawal)

1. Members may cancel their membership to the Service at any time by going through the cancellation procedures specified by our company.

If you wish to cancel your membership, please contact us at info@f-points.com with "Request to cancel F-POINT official app membership" in the subject line of an email and your member name, customer ID, and date of birth in the body of the email.

2. If you registered using a Facebook account, all Facebook information stored in our system will also be deleted.

3. Upon withdrawal from the Service, the Member will lose all points held, as well as all rights and benefits relating to the use of the Service, and the Company shall not be liable for any damages or other disadvantages suffered by the Member as a result thereof.

4. After canceling your membership, even if you re-register for this service, you will not be able to carry over any data you had before canceling your membership.
